Proportionality and Do No Harm
This thematic area measures steps countries have taken to integrate the principles of proportionality and do no harm into AI systems, and to implement safeguards in the design and operation of AI systems.
Proportionality can be defined as ‘the fact or quality of being in proper balance or relation as to size or quantity, degree, severity, etc’. As a foundational principle of international law, proportionality supports the need for actions to be both fair and just.

In the context of AI, proportionality demands the use of AI systems to not ‘exceed what is necessary to achieve legitimate aims or objectives and should also be appropriate to the context’.
Similarly, the principle of 'do no harm' mandates actions to avoid causing injury or injustice to people. When combined, these principles necessitate that AI systems not be used in ways that cause or worsen harm, whether at an individual or communal level, encompassing injuries and injustices affecting social, cultural, economic, natural, or political environments. It's important to distinguish the principle of ‘do no harm’ (non-maleficence) from ‘do only good’ (beneficence), where the former focuses on preventing the overuse or misuse of AI technologies, while the latter emphasizes creating AI technology to benefit humanity and the planet.

It is crucial for AI actors to center their practices on the foundational principle of 'do no harm', not only in high-risk technology contexts but also in high-risk environments. They should proactively mitigate risks and address harms caused by AI to prevent human rights abuses over time.
